These terms govern your use of hechlerpainting.com and describe the general terms under which Hechler's Painting and Wall Scraping LLC provides painting and surface restoration services in Pennsylvania and New Jersey. By using this website you agree to these terms.
Nothing on this website constitutes a contract for work. All work is performed under a separate written agreement signed by both parties.

Services
We provide interior and exterior painting, wallpaper removal and installation, plaster and drywall repair, skim coating, popcorn ceiling removal, cabinet painting and refinishing, wood staining and varnishing, deck and fence finishing, wood rot and carpentry repair, pressure washing, caulking and weatherproofing, commercial and multi-family painting, garage floor coatings, and elastomeric wall coatings.
We do not perform lead inspections, lead risk assessments, lead abatement, or asbestos abatement, and we do not issue lead-safe or lead-free certifications. Those services must be obtained from appropriately certified or licensed contractors.
Estimates and proposals
Estimates are provided free of charge and without obligation. An estimate is valid for thirty days from the date issued unless stated otherwise.
Estimates are based on the conditions visible and reasonably discoverable at the time of the walkthrough. Painting and restoration work regularly uncovers conditions that could not be seen beforehand, including but not limited to concealed wood rot, failed or separated plaster, moisture damage, mold, previous repairs performed improperly, unstable existing coatings, and additional layers of wallpaper. Where such conditions are found, we will notify you and provide a written change order before performing additional work.
Contracts, your right to cancel, and deposits
For residential work in Pennsylvania, home improvement contracts are governed by the Home Improvement Consumer Protection Act. Contracts exceeding $500 are in writing and signed by both parties, include our registration number, include a description of the work, the total price, and estimated start and completion dates, and include your right to rescind the contract within three business days of signing. Down payments are limited in accordance with that statute.
For residential work in New Jersey, contracts are governed by the Contractors' Registration Act and its regulations, including written contract requirements and your applicable right of cancellation.
Where the two states' requirements differ, the requirements of the state in which the property is located apply.
Scheduling, weather, and delays
Exterior work is weather dependent. Coatings require appropriate temperature, surface dryness, and cure conditions, and we will postpone exterior work rather than apply a coating in conditions that will cause it to fail. We are not liable for delays caused by weather, material availability, or conditions concealed prior to the start of work.
We will communicate schedule changes as soon as we are aware of them.
Payment
Payment terms are set out in your written agreement. Unless stated otherwise, final payment is due upon completion and your acceptance at the final walkthrough. Accounts not paid within the agreed terms may be subject to late charges and collection costs as permitted by law.
Your responsibilities
You agree to provide reasonable access to the work areas, a source of water and electricity where required, and a safe working environment. You agree to remove or identify fragile, valuable, or irreplaceable items before work begins.
You agree to disclose known conditions relevant to the work, including known lead-based paint, known asbestos-containing materials, active leaks or water intrusion, prior pest or mold treatment, and any restrictions applicable to the property such as historic district requirements or homeowner association rules.
For properties subject to review by a historic commission, an association, or a municipality, obtaining any required approvals is your responsibility.
Lead-based paint and asbestos
Housing built before 1978 may contain lead-based paint. We follow lead-safe work practices where applicable when disturbing painted surfaces in pre-1978 housing.
Ceiling and wall textures applied before the early 1980s may contain asbestos. We do not disturb suspected asbestos-containing materials. Where such material is suspected, testing must be performed before work proceeds, and any positive result requires a licensed abatement contractor.
Where a property owner has obligations under the Philadelphia Lead Paint Disclosure and Certification Law, New Jersey's lead-based paint inspection requirements for rental dwellings, or any other applicable rule, meeting those obligations remains the owner's responsibility. Our work may address the condition of painted surfaces. It does not constitute an inspection, a certification, or a determination of compliance.
Workmanship
We warrant our workmanship for the period stated in your written agreement. This warranty covers defects in our application and preparation. It does not cover failures arising from conditions outside our control, including water intrusion from roofs, gutters, flashing, plumbing, or grading; structural movement or settlement; substrate failure disclosed to you and declined for repair; damage from impact, abuse, or neglect; normal wear and fading; or work performed by others.
Manufacturer warranties on materials are provided by the manufacturer and are passed through to you where applicable.
Photography
We may photograph completed work for our portfolio and marketing. Photographs will not include identifying information about the property or the owner without permission. Tell us if you would prefer that we do not photograph your project and we will not.
Insurance
We carry general liability insurance. Certificates are available on request. Please ask before work begins if you or your association require one.
Limitation of liability
To the fullest extent permitted by law, our liability arising out of the work is limited to the amount paid for that work. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits any liability that cannot be limited under applicable law.

Governing law
